Every work on Jewish thought and law since the twelfth century bears the imprint of Maimonides. A.N. Whitehead's famous dictum that the entire European philosophical tradition 'consists of a series of footnotes to Plato' could equally characterize Maimonides' place in the Jewish tradition. The critical studies in this volume explore how Orthodox rabbis of different orientations--Shlomo Aviner, Naftali Zvi Yehudah Berlin (Netziv), Kalonymus Kalman Shapira, Joseph Kafih, Abraham Isaac Kook, Aaron Kotler, Joseph Soloveitchik, and Elhanan Wasserman--have read and provided footnotes (...) to Maimonides in the long twentieth century. How well did they really understand Maimonides? And where do their arguments fit in the mainstream debates about him and his works? Each of the seven core chapters examines a particular approach. Some rabbis have tried to liberate themselves from the influence of his ideas. Others have sought to build on those ideas or expand them in ways which Maimonides himself did not pursue, and which he may well not have agreed with. Still others advance patently non-Maimonidean positions, while attributing them to none other than Maimonides. Are they primarily social chronicles, as Turgenev suggested, or are they rather to be seen as celebrations of life, of the beauty of love and youthful idealism? Are they paens to the nobility of the human spirit or ironic comments on human folly? The seven deadly sins have provided gossip, amusement, and the plots of morality plays for nearly fifteen hundred years. Why is American punishment so cruel? While in continental Europe great efforts are made to guarantee that prisoners are treated humanely, in America sentences have gotten longer and rehabilitation programs have fallen by the wayside. Western Europe attempts to prepare its criminals for life after prison, whereas many American prisons today leave their inhabitants reduced and debased. In the last quarter of a century, Europe has worked to ensure that the baser human inclination toward vengeance is not reflected by state (...) policy, yet America has shown a systemic drive toward ever increasing levels of harshness in its criminal policies. Why is America so short on mercy? In this deeply researched, comparative work, James Q. Whitman reaches back to the 17th and 18th centuries to trace how and why American and European practices came to diverge. Eschewing the usual historical imprisonment narratives, Whitman focuses instead on intriguing differences in the development of punishment in the age of Western democracy. European traditions of social hierarchy and state power, so consciously rejected by the American colonies, nevertheless supported a more merciful and dignified treatment of offenders. The hierarchical class system on the continent kept alive a tradition of less-degrading "high-status" punishments that eventually became applied across the board in Europe. The distinctly American, draconian regime, on the other hand, grows, Whitman argues, out of America's longstanding distrust of state power and its peculiar, broad-brush sense of egalitarianism. Low-status punishments were evenly meted out to all offenders, regardless of class or standing. America's unrelentingly harsh treatment of trangressors--this "equal opportunity degradation"-- is, in a very real sense, the dark side of the nation's much vaunted individualism. The Epicurean philosophical system has enjoyed much recent scrutiny, but the question of its philosophical ancestry remains largely neglected. It has often been thought that Epicurus owed only his physical theory of atomism to the fifth-century BC philosopher Democritus, but this study finds that there is much in his ethical thought which can be traced to Democritus. It also finds important influences on Epicurus in Democritus' fourth-century followers such as Anaxarchus and Pyrrho, and in Epicurus' disagreements with his own Democritean (...) teacher Nausiphanes. The result is not only a fascinating reconstruction of a lost tradition, but also an important contribution to the philosophical interpretation of Epicureanism, bearing especially on its ideal of tranquillity and on the relation of ethics to physics. The infant mortality rate in Liberia is 50 times higher than it is in Sweden, whilst a child born in Japan has a life expectancy at birth of more than double that of one born in Zambia. 1 And within countries, we see differences which are nearly as great. For example, if you were in the USA and travelled the short journey from the poorer parts of Washington to Montgomery County Maryland, you would find that ‘for each mile travelled life (...) expectancy rises about a year and a half. There is a twenty-year gap between poor blacks at one end of the journey and rich whites at the other’. (Marmot, 2004, p.2). There are two types of questions which it is important to ask about inequalities in health such as these. The first are social scientific questions about the extent of inequalities in health and the factors which are causally responsible for these inequalities. Examples of social scientific questions to ask might be: how do infant mortality rates in the UK differ according to social class? What is the difference in life expectancy between Japanese who emigrate to the US and those who remain in Japan? Why do civil servants in higher ranked jobs tend to live longer than civil servants in lower ranked jobs? The second type are normative questions about the reasons we have to care about inequalities in health. Important normative questions to answer are: which inequalities in health should we care about (all inequalities or merely some of them)? When is an inequality in health unjust? How should we weigh our concern for equality in health against other factors such as maximising the.. (shrink)

The identity and diversity of individual objects may be grounded or ungrounded, and intrinsic or contextual. Intrinsic individuation can be grounded in haecceities, or absolute discernibility. Contextual individuation can be grounded in relations, but this is compatible with absolute, relative or weak discernibility. Contextual individuation is compatible with the denial of haecceitism, and this is more harmonious with science. Structuralism implies contextual individuation. Fascism has traditionally been characterized as irrational and anti-intellectual, finding expression exclusively as a cluster of myths, emotions, instincts, and hatreds. This intellectual history of Italian Fascism--the product of four decades of work by one of the leading experts on the subject in the English-speaking world--provides an alternative account. A. James Gregor argues that Italian Fascism may have been a flawed system of belief, but it was neither more nor less irrational than other revolutionary ideologies of the twentieth century. (...) When we talk about intellectual property, it is often implicitly assumed that we are talking about private intellectual property. However, private property and the idea of private ownership do not exhaust the possibilities for accounts of ownership and of property. There are other ways that ownership can operate, such as common property. We continue the work of [14, 3, 1, 19, 16, 4, 12, 11, 20] investigating the strength of set existence axioms needed for separable Banach space theory. We show that the separation theorem for open convex sets is equivalent to WKL 0 over RCA 0 . We show that the separation theorem for separably closed convex sets is equivalent to ACA 0 over RCA 0 . Our strategy for proving these geometrical Hahn-Banach theorems is to reduce to the finite-dimensional case (...) by means of a compactness argument. (shrink)

After reconstructing three arguments for Nietzsche’s descriptive analysis of the self as complex, this article clarifies some of greatness’s psychological conditions. It then offers three arguments for why we should not focus on these internal conditions when seeking to verify or to achieve greatness. First, Nietzsche’s descriptive analysis of the self renders introspection too coarse-grained and error-prone to verify the subtle type of unity required for greatness. Second, Nietzsche associates introspective appraisal of one’s psyche with a moral project that weakens (...) and represses the drives, such that inquiry into whether greatness’s internal conditions are satisfied typically speaks against their realization. Finally, the actions characteristic of Nietzsche’s great individuals prohibit introspective preoccupation with oneself. These arguments suggest that we should attend to outwardly directed accomplishments, rather than psychology, when appraising the greatness of others and seeking to become great ourselves. (shrink)

This paper examines the relative voluntariness of three types of virtue: 'epistemic' virtues like open-mindedness; 'motivational' virtues like courage, and more robustly 'moral' virtues like justice. A somewhat novel conception of the voluntariness of belief is offered in terms of the limited, but quite real, voluntariness of certain epistemic virtues.

Remhof contends that Nietzsche is a metaphysician. According to his Meta-Metaphysical Argument, Nietzsche’s texts satisfy the criteria for an adequate conception of metaphysics. According to his Constructivist Argument, Nietzsche adopts a metaphysical position on which concepts’ application conditions constitute the identity conditions of their objects. This article critically appraises these arguments. I maintain that the criteria advanced in the Meta-Metaphysical Argument are collectively insufficient for delineating metaphysics as a distinct field of inquiry and that the Constructivist Argument attributes a position (...) to Nietzsche that remains vulnerable to his evaluative and psychological indictments of two-world metaphysics. I conclude by discussing how these objections might help non-metaphysical readers of Nietzsche resist Remhof’s interpretation. (shrink)

As scientists target communities for research into the etiology, especially the genetic determinants of common diseases, there have been calls for the protection of communities. This paper identifies the distinct characteristics of aboriginal communities and their implications for research in these communities. It also contends that the framework in the Belmont Report is inadequate in this context and suggests a fourth principle of respect for communities. To explore how such a principle might be specified and operationalized, it reviews existing guidelines (...) for protecting aboriginal communities and points out problems with these guidelines and areas for further work. Callaway, has included a new Introduction which elucidates the legacy of Jamesian pluralism to survey some related questions of contemporary (...) It is a substantial philosophical work, devoted to a thorough-going criticism of Hegelian monism and Absolutism—and the exploration of philosophical and social-theological alternatives. At present, we are more certain that American is, and is best, a pluralistic society, than we are of what particular forms our pluralism should take. Despite the importance of effective observational analysis in the technical aspects of climbing performance, limited research informs this aspect of climbing coach education. Thus, the purpose of the present research was to explore cognitive-perceptual mechanisms underpinning visual search strategies of expert and novice climbing coaches through the novel combination of eye-tracking technology and retrospective think-aloud methodology. Analysis of gaze data revealed expert climbing coaches to demonstrate fewer fixations of greater duration, and fixate on distinctly different areas of the visual display, (...) than their novice counterparts. Retrospective think-aloud interviews further demonstrated differences in the cognitive-perceptual mechanisms underpinning these visual search strategies, with expert coaches more cognisant of their visual search strategy. To expand, the gaze behaviour of expert climbing coaches was underpinned by hierarchical and complex knowledge structures relating to principles of climbing movement. This enabled expert coaches to actively focus on the most relevant aspects of a climber’s performance for analysis. Findings demonstrate the utility of combining eye tracking and retrospective think-aloud interviewing as a new, efficient methodology of capturing the cognitive-perceptual processes of climbing coaches to inform coaching education/strategies. Abstract:This paper is an analysis of Plato's use of the embassy to Achilles in Homer's Iliad book 9 as a literary template for Crito's mission to persuade Socrates to escape from prison in Athens. Plato's purpose is to elevate the nature of a hero by contrasting the impulsive, impetuous, mercurial temper of Achilles with the steady, thoughtful, deliberative, calmly rational argument of Socrates. Plato shows, in a volley fired at the poet, how the philosopher is more meaningfully heroic than the (...) warrior, for where the warrior aims selfishly at securing his own honor, the philosopher aims at political virtue. Since its introduction in 1987, Benjamin Freedman’s principle of clinical equipoise has enjoyed widespread uptake in bioethics discourse. Recent years, however, have witnessed a growing consensus that the principle is fundamentally flawed. One of the most vocal critics has undoubtedly been Franklin Miller. In a 2008 paper, Steven Joffe and Miller build on this critical work, offering a new conception of clinical research ethics based on science, taking what they call a “scientific orientation” toward the ethics of clinical research. Though (...) there is much to recommend Joffe and Miller’s scientifically oriented conception of clinical research ethics, I believe that both the critical and constructive projects suffer from the same basic mistake: inattention to context. The internal norms of science cannot be fully specified, let alone satisfied, independently of contextual (external) factors that only come into view when we are attentive to the particular context of that form of inquiry. It could be argued that some in the military, like certain local officials, are the last holdouts against the reform's ideological “thaw” toward religion, though Kharčev's October–November, 1989, interview inOgonëk makes clear that there are still some higher-level forces in “the apparatus” who remain opposed to some of the changes. It could be that some of the reformers themselves are concerned about the pace of change. Even in their minds the “thaw” undoubtedly has limits. They may view the present controversy (...) over restructuring “scientific atheism” and redefining socialism's attitude toward religion as a necessary and desirable part of the dialectical process. Thus, while encouraging a tactical and more humane detente toward religion, they have not yet moved to eliminate the basis for ideological hostility toward it. They simply want that hostility to be better channeled and controlled, while exploiting the political benefits that their new-found truce with religion offers. Looking at Gorbachevism, Soviet émigré observer Aleksandr Zinov'ev believes that the reform process “in the sphere of internal political activity concerns only separate phenomena ... but by no means the very foundations of the social system, the system of power and ideology.” That system, he believes, is not yet fundamentally changing in those terms.
